Commercial Cannabis Regulations

Important Definitions:

  • Sensitive Receptor: A Daycare, school, or youth center
  • Personal Use: Cannabis operations for personal use are defined as the cultivation, harvesting, drying, or processing of cannabis plants with the intent to possess, smoke, or ingest cannabis or cannabis products for one's own individual use or by a primary caregiver for their qualified patient(s) in accordance with State law. State law permits individuals to grow up to six plants for personal use, and the County Ordinances require cultivation for personal use to occur within any secure dwelling or accessory structure.

Zoning Regulations

Zoning - Where and how you can start a commercial cannabis operation depends on which zone your parcel is located in.

What's Allowed in this Zone:

  • Within 750-feet from a sensitive receptor
  • Within Coastal Zone per Business and Professional Code (Not in ordinance)
  • Land Use Permit prior to the commencement of any cannabis activity
  • Valid County annual business license
  • Valid State annual license

General Development Standards apply, including:

  • Archaeological and paleontological surveys for lots that have not been subject to prior surveys
  • Fencing and security plan
  • Landscape Plan and Screening Plan
  • Lighting Plan
  • Odor Abatement Plan if CUP Required
  • Signage Requirements
  • Tree Protection, Habitat Protection, and Wildlife movement plans where the activities would involve the removal of native vegetation or other vegetation in an area that has been identified as having a medium to high potential of being occupied by a special-status wildlife species, nesting bird, or a Federal or State-listed special-status plant species
  • Noise Plan

Specific Use Development Standards apply, including:

  • Avoidance of prime soils
  • Compliance with Cannabis Waste Discharge Requirements General Order
  • No hoop structure lighting
  • No use of public lands
  • Site Transportation Demand Management Plan
  • Water efficiency
  • Within 750-feet from a sensitive receptor
  • Land Use Permit prior to the commencement of any cannabis activity
  • If cultivation occurs on lots located in an Existing Developed Residential Neighborhood (EDRN) or requires the use of a roadway located within an EDRN as the sole means of access to the lot, then a Conditional Use Permit is required
  • Valid County annual business license
  • Valid State annual license

  • No cannabis manufacturing shall be permitted as a Home Occupation including Cottage Food Operations and In-home Retail Sales in accordance with Chapter 35.42.190 (Home Occupations).

  • Land Use Permit prior to the commencement of any cannabis activity
  • Valid County annual business license
  • Valid State annual license

Home Occupation

  • No cannabis manufacturing shall be permitted as a Home Occupation including Cottage Food Operations and In-home Retail Sales in accordance with Chapter 35.42.190 (Home Occupations).

Volatile Manufacturing Employee Training Plan.

  • The applicant shall prepare and submit to the Department for review and approval a Volatile Manufacturing Employee Training Plan. The Volatile Manufacturing Employee Training Plan shall be implemented prior to the issuance of final building inspection and/or throughout operation of the project, as applicable. The Volatile Manufacturing Employee Training Plan shall include, at a minimum, the following elements:
    1. Training employees on the proper use of equipment and on the proper hazard response protocols in the event of equipment failure.
    2. A log, identifying trained employees and the date upon which training was completed. The operator shall maintain the Employee Training Log for a minimum of five years.

  • The applicant must be approved through the Cannabis Business Licenses process before a zoning permit will be processed
  • No cannabis consumption, including, but not limited to, smoking, vaporizing or ingesting, shall be permitted on the premises of a retailer or microbusiness.
