Instructions for Submitting a Cannabis Business License Application

 

The Accela on-line Cannabis Business Licensing application portal is now "Live" and replaces the fillable-form PDF application that was formerly used. This new Accela application provides applicants the ability to complete and submit a Cannabis Business License application on-line, upload supporting documentation, and view the status of the application at every step of the process, providing much needed transparency to the applicant. Please thoroughly read all instructions below, prior to starting a Cannabis Business License Application.

Please note: According to the federal Controlled Substance Act cannabis is a Schedule I drug and obtaining a Cannabis Business License from the County does not protect any person from prosecution pursuant to any laws that may prohibit cannabis activities.  (See Santa Barbara County Code § 50-1.)  In addition, information provided in this application may be subject to disclosure as required by any federal or state laws, including the California Public Records Act.

Step 1: Establish Username & Password 

Step 2: Complete the Pre-Qualification Application

  1. Complete all required fields (please note, an applicant may request more than one license type in this Pre-Qualification application for a given fixed location, however, the license type(s) must be consistent with the project description of the corresponding land use entitlement).
  2. Upload supporting documentation, as requested – if the requested supporting documentation is not applicable, please upload a document that thoroughly explains the reason why the requested supporting documentation is not provided. Please use the list of resource documents available on the Business Licensing page of the County's Cannabis Website to assist in compiling the requested documentation and information.
  3. Submit Pre-Qualification Application

Step 3: Pay the Cannabis Business License Application Deposit Fee ($3,250)

  1. A deposit fee in the amount of $3,250 must be submitted to the County Executive Office before staff will begin to process the application. This application deposit fee must be submitted AFTER the Pre-Qualification Application has been submitted. Deposit fees will not be accepted unless a Pre-Qualification Application has been submitted.
  2. Only checks or money orders will be accepted at this time. NO cash, credit/debit cards will be accepted.
  3. Cannabis Business License Application deposit fees may be submitted in person or via U.S. mail to the following address: 105 East Anapamu Street, Room 407, Santa Barbara, CA 93101
  4. California law adds a State fee of $4 on any applicant for a local business license or renewal thereof. (Gov. Code § 4465 et seq.) The purpose is to increase disability access and to develop educational resources for businesses in order to facilitate compliance with disability laws. Under federal and state law, compliance with disability access laws is a serious and significant responsibility that applies to all California building owners and tenants with buildings open to the public. Step 4: Review of Pre-Qualification Application by the County's Business Licensing Team

  1. The team of cannabis business licensing review staff will review documentation and provide feedback to the applicant on any deficiencies that need addressing before they may continue processing the application or provide their department's approval of the application.
  2. Once approval from all reviewing departmental staff is obtained, the Pre-Qualification application as a whole will be approved and the applicant will be notified. The applicant will then be instructed via email, to complete a Facility License Application that is auto-generated and is found in each user's collection of Accela Cannabis Records. 

Step 5: Complete the Facility License Application (specific to each unique license type being applied for)

  1. The auto-generated record mentioned in Step 3 will show a record number similar to the following: 20TMP-000004. Under the "Action" column, a hyperlink will appear that reads "Resume Application" – the applicant must complete a separate Facility License Application for each unique license that is being applied for.
  2. Please note, some Information that is entered in the Pre-Qualification Application is automatically carried forward and populates each Facility License Application.
  3. Populate any required fields.
  4. Upload any required documentation. Please note, this portion of the application has been configured to require documentation specific to the license type that is being applied for. Similar to the Pre-Qualification application, if the requested supporting documentation does not apply to the business entity that is applying for a cannabis business license, please upload a document that thoroughly explains the reason why the requested supporting documentation is not provided.
  5. Submit the Facility License Application for each unique license type that is being applied for.
  6. Upon successful submittal of a Facility License Application, a license Record number will be auto-generated similar to the following: CNBS-MFR-A20-0001. This new Facility License Application Record Number will appear in each user's collection of Accela Cannabis Records. 

Step 6: Business Licensing Team Review of Facility License Application

  1. The team of cannabis business licensing review staff will review documentation and provide feedback to the applicant on any deficiencies that need addressing before they may continue processing the application or provide their department's approval of the application.
  2. If satisfied with the documentation, the team of cannabis business licensing review staff may begin reaching out to the applicant to schedule site inspections. 
  3. Once approval from all reviewing departmental staff is obtained, the Facility License Application will be approved. The applicant will be notified via email of the approval of the Facility License Application, and instructions will be provided on adding employees to the application. 

Step 7: Cannabis Employee Registration

  1. In each user's collection of cannabis application records, navigate to the newly created Facility Licenses Application Record Number. Under the column titled "Action" click on the hyperlink titled "Amendment" – from here, the applicant will then be able to add all employee names and upload supporting documentation (e.g. government-issued identification).
  2. Once all employee names and information are entered, and supporting documentations has been uploaded, the applicant must submit these changes so that the business licensing team may perform background checks and provide employees with identification badges that must be worn on-site at all times.

Step 8: Final Cannabis Business License Approval and License Issuance

  1. Upon staff's approval of the Facility License Application and associated amendment to add employees, if applicable, the applicant will receive notification that they are officially approved for issuance of a cannabis business license for the specific activity and license type for which they applied.
  2. After obtaining final approval of a cannabis business license, the Treasurer Tax-Collector's Office will print the cannabis business license and notify the applicant that it is ready for pick-up.
